Requirements for Reporting

Group health plans and health insurance issuers must annually submit to the Secretary, and to enrollees under plan coverage, a report that specifies whether or not the plan meets established guidelines. (pp 31, lines 21-25, pp 32, lines 1 – 3).

  • Such report will be made to enrollees during the plan’s open enrollment period (pp 32, lines 4 – 7).
  • The Secretary will make the reports available to the public via the Internet (website) (pp 32, lines 8 -11).
  • The Secretary may develop and impose penalties for those in violation of (or non-compliance with) these reporting requirements (pp 32, lines 12 – 16).
  • The Secretary may provide for exceptions in some cases where insurers otherwise substantially meet the goals of reporting. (pp 32, lines 17 -22).
